How Far Can a Parent Move with Joint Custody in Arizona?
If a joint custody order has been made, the parent that is relocating is required to give the other parent 45 days’ notice prior to an out-of-state move or an interstate move that is 100 miles away (A.R.S.§ 25-408) .
It is important to note that the parent that is not moving can petition the court, within 30 days of the notice, to stop the relocation.
Can I Move Out of State With My Child Without the Father’s Permission in Arizona?
No, notice must be given to the other parent in the event of a relocation.
What Does the Judge Consider in a Relocation Case?
Whether a parent is requesting to relocate or the other parent is trying to prevent the move, the judge will look at a variety of factors to determine what is in the child’s best interest.

- Why the parent is wanting to move
- If the move will enhance quality of life
- What the child’s relationship is like with both parents
- How visitation will be affected with the parent that is not relocating
- How the move will affect the child
